Hearing in a case of alleged impersonation, forgery and obtaining money under false pretence filed against Joseph Badmus and Akeju Bola, was on Wednesday stalled in an FCT High Court.

The EFCC filed the suit against the accused persons for parading themselves as EFCC officials to defraud unsuspecting victims of millions of Naira. The accused persons claimed they would use the money to suppress petitions pending before the commission.

The EFCC said the offences were committed between October 2012 and May 2013 in Abuja.

At the resumed hearing of the case before Justice Mudashiru Oniyangi, the prosecution counsel, Mr Chris Mshelia, told the court that the matter which was slated for hearing could not hold because he was served with a motion on preliminary objections.

"My Lord I was served with the preliminary objections by the accused counsel only yesterday. In the motion, the accused is challenging the jurisdiction of this Honourable court to entertain the matter,'' he said.

He prayed the court to grant an adjournment to enable him reply to the issues raised by the accused counsel.

The accused counsel, Mr Isaiah Opwaje, did not object to the prayer for adjournment, but prayed the court to order the police to release a vehicle belonging to Badmus.

But the judge ordered that Badmus’ vehicle be kept in police custody, and adjourned the case to Dec. 4.

The accused persons were arraigned on Oct. 15 on a 30-count charge bordering on impersonation and forgery.

The offence, the anti-graft agency said, is punishable under section 132 of the Penal Code Cap 532 Laws of the Federation of Nigeria (Abuja) 1990.

The accused persons pleaded not guilty to the charge.
