Metro Nasarawa Court Releases Man Charged With Abduction, Attempted Rape over Lack of Witnesses

A Grade 1 Area Court at Aso Pada, Mararaba in Nasarawa State on Tuesday discharged one David Monday, 25, of Aso C, Mararaba, charged with abduction and attempted rape.

At the resumption of hearing, the Prosecutor, PC Friday Adaji, told the court that he could not get the complainant, Esther Patrick, of Aso, Mararaba to give her testimony.

He then applied to the court to give him more time to enable him bring forth his witnesses.

The Judge, Mr Albert Maga, refused Adaji’s application, struck out the case and discharged the accused

"This matter was first mentioned in this court on Oct. 10 and the prosecution has enjoyed several adjournments without producing any witness to testify.

"The matter is hereby struck out and the accused discharged,” Maga ruled.

Monday had been arraigned on Oct 10. for abduction and attempted rape.

On that date, Adaji told the court that one Esther Patrick of Aso in Mararaba lodged a complaint against the accused on Oct. 3, at the ‘A’ Division Police Station, Mararaba.

Adaji had alleged that the accused conspired with six people, now at large, and lured the complainant to an uncompleted building in Aso Pada and attempted to rape her.

He said that the complainant was rescued by a man in the neighbourhood, who heard her screams for help.

Monday had pleaded not guilty.
