Former Vice President Atiku Abubakar has applied to the Supreme Court for permission to introduce fresh evidence in his case against President Bola Tinubu. Atiku seeks to present academic records from Chicago State University, alleging that Tinubu submitted forged documents to the Independent National Electoral Commission (INEC) to qualify for the presidential election held on February 25.

According to Atiku, these records, totaling 32 pages, were released by the Chicago State University on October 2, 2023, under the orders of Judge Nancy Maldonado of the District Court of Illinois. He contends that President Tinubu's actions constitute forgery and perjury, justifying his removal from office.

Atiku's application cites Supreme Court Rules 1985, Section 137(1) of the 1999 Constitution, and the court's inherent jurisdiction. He prays for leave to introduce the evidence and requests that it be accepted as an exhibit in the resolution of his appeal.

The motion rests on various grounds, including the belief that the deposition "would have important effect in the resolution of this appeal." The Supreme Court has yet to schedule a hearing date for this motion.
