Business UPDATE: NCC's Position on MTN $3.9bn Fine as Deadline Approaches

The Nigerian Communications Commission on Thursday issued a statement concerning the $3.9bn fine it imposed on MTN Nigeria for failing to disconnect unregistered customers on its network.

The Nigerian regulator had given Africa's biggest telecoms company up to December 31st to pay up or face serious repercussions.

"The deadline remains,” Tony Ojobo, a spokesperson for NCC said recently.

He added that the NCC will consult with lawyers about what to do if the Johannesburg-based company doesn’t pay the fine on Thursday. He however didn't provide detail on possible actions the regulator may take.

The fine, if paid might see MTN go under and it's CEO had resigned shortly after the fine was announced. Also, MTN after series of negotiations with the Nigerian government had gone to court in a bid to seek a favorable outcome to the debacle.

However, Nigerian authorities on December 24, said it will wait for the outcome of the court challenge before deciding on whether to the fine.

"The federal government, NCC (regulator) or any government agent will not do anything at the expiration of the December 31 deadline," said Victor Oluwadamilare, the telecommunications ministry's media assistant.

"Now that they (MTN) have gone to court we will await the outcome of the case," he added. "This is a government that believes in the rule of law."
